THE HOUSE PROVISION THAT IS OMITTED IN THE SENATE BILL would repeal Section 709-908 of the Hawaii Revised Statutes, which was passed last year and received extensive media coverage, as it is the section of law that made Hawaii the first U.S. state to increase the purchase age of tobacco and vapor products from 18 to 21.
What This Could Mean: One option is that this omitted provision is the crux on which the bill's Senate approval rests. For whatever reasons, Senator Agaran could believe that the bill will not survive with this provision. Another option is that he may have decided that it was not in conflict with s. 709-908, and could simply be added as its own section without repealing an enacted portion of the Hawaii Revisited Statutes. The Senator could have spoken with the House sponsor and they collaborated to introduce slightly different bills with the hope that at least one version would garner sufficient support. On the other hand, there may have been no strategy behind the omission at all. It could have been simple oversight or a clerical error.
