CBD is legal in Canada. However, it is surrounded by a highly restrictive regulatory framework. Currently, the sale of CBD is regulated the same as cannabis products, regardless of whether or not it was derived from hemp. Retailers who wish to sell, produce, test or distribute CBD must have a licence issued by their province. Not everyone can engage in the sale of CBD as the Cannabis Act specifies that āA person may only possess, sell, or distribute CBD if they are authorised under a provincial Actā.
