US - New York: The Office of Cannabis Management has written to stakeholders reminding them that delta-8 and delta-10 THC products that are converted from other cannabinoids may not be sold through the state’s Cannabinoid Hemp Program and are more appropriately regulated by the recreational and medical cannabis programmes, press reports. “To clarify any confusion surrounding these products, we are advising you that the sale of any cannabinoid hemp products which contain Delta-8 THC or Delta-10 THC created through isomerization, are strictly prohibited in the Cannabinoid Hemp Program,” the letter reportedly states.

US - New York: The New York Cannabis Control Board has approved the first 52 licences to be issued for the state’s recreational cannabis programme.

US - New York: State lawmakers included in their budget proposal to the governor a measure that would allow cannabis businesses to make state tax deductions for business expenses despite the federal prohibition on cannabis, press reports. If signed by governor Kathy Hochul, the measure will take effect for the 2022 tax year.

New York: Governor Kathy Hochul has signed and enacted companion bills Senate Bill 8084 and Assembly Bill 9283. The bills allow for licensed hemp cultivators and processors to produce and process recreational cannabis under a temporary conditional licence. Among other requirements, applicants must have been licensed hemp cultivators or processors in the state as of 31st December 2021 and produced or processed hemp during two of the previous four years. The bills are intended to kick-start cannabis production to supply demand for recreational cannabis when sales begin. Before applications will be accepted the Office of Cannabis Management must establish application fees and conditions for the licence, including “the requirement that a licensee agrees to participate in an environmental sustainability program and a social equity mentorship program”.
