More relaxed enforcement measures allow Austrian market to develop

CBD is not considered a scheduled substance under the Narcotic Substance Act, nor does it fall under the medicinal regime as it is not considered a pharmaceutical substance. However, according to the Austrian Agency for Health and Food Safety (AGES), the medicinal efficacy and safety of cannabidiol alone (without combination with THC) is currently being investigated in clinical studies. This means that producers and sellers should refrain from making any related claim. According to the ministry’s interpretation, however, not all finished end-products are allowed.

The enforcement since the change of the government in September 2019 is seemingly more relaxed, and the inspecting authorities have been maintaining a steady dialogue with the industry. As a result, we have seen new CBD products being introduced to market, which is now flourishing in all product categories.
